En \u00e9change d\u2019une r\u00e9mun\u00e9ration, le travailleur s\u2019engage \u00e0 effectuer une t\u00e2che pour l\u2019employeur.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eb0aea4 elementor-widget elementor-widget-text-editor\" data-id=\"eb0aea4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Le contrat de travail n\u2019a aucune valeur s&rsquo;il ne respecte pas les lois du travail, m\u00eame en cas d\u2019entente entre l\u2019employeur et le travailleur.<\/p><p>En plus de pr\u00e9ciser les t\u00e2ches \u00e0 faire par l\u2019employ\u00e9 et la dur\u00e9e de l\u2019entente, le contrat de travail devrait aussi faire \u00e9tat des conditions de travail (salaire, horaires, cong\u00e9s, etc.). M\u00eame s\u2019il peut \u00eatre d\u00e9termin\u00e9 \u00e0 l\u2019oral, il est recommand\u00e9 de fixer le contrat de travail \u00e0 l\u2019\u00e9crit, pour \u00e9viter les malentendus.<\/p><p>La forme du contrat de travail peut varier en fonction de l\u2019entreprise ou du statut du travailleur. Un mod\u00e8le de contrat de travail est mis \u00e0 disposition par la CNESST et peut \u00eatre adapt\u00e9 par les employeurs en fonction de leur situation. Le minist\u00e8re de l\u2019Immigration, de la Francisation et de l\u2019Int\u00e9gration (MIFI) propose \u00e9galement un mod\u00e8le de contrat de travail sp\u00e9cifique aux travailleurs \u00e9trangers temporaires (TET).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-17b61a17 elementor-position-inline-start elementor-mobile-position-inline-start ferm\u00e9 au Qu\u00e9bec est tenu de fournir un contrat de travail \u00e9crit, conform\u00e9ment aux exigences du gouvernement du Qu\u00e9bec.<\/p>\n<p>Cette r\u00e8gle s\u2019applique \u00e0 tous les types de TET relevant des programmes :<\/p>\n<ul>\n<li>Des travailleurs \u00e9trangers temporaires (PTET) ;<\/li>\n<li>Des travailleurs agricoles saisonniers (volet travailleurs agricoles du PTET et PTAS). En effet, c\u2019est par lui que les autorit\u00e9s valideront l\u2019ad\u00e9quation du candidat au poste au moment d\u2019\u00e9valuer l\u2019impact de son embauche sur le march\u00e9 du travail (EIMT).<\/p><p class=\"p1\">Ainsi, l\u2019employeur sera avis\u00e9 de d\u00e9crire avec soin les t\u00e2ches \u00e0 r\u00e9aliser, de mani\u00e8re \u00e0 refl\u00e9ter \u00e0 la fois la r\u00e9alit\u00e9 du poste \u00e0 pourvoir, mais aussi les comp\u00e9tences du travailleur \u00e9tranger.<\/p><p class=\"p1\">Le TET doit \u00eatre en possession de son contrat de travail avant que l\u2019employeur n\u2019envoie la demande de s\u00e9lection temporaire (DST) conjointe \u00e0 Emploi et D\u00e9veloppement social Canada (EDSC, f\u00e9d\u00e9ral) et au minist\u00e8re de l\u2019Immigration, de la Francisation et de l\u2019Int\u00e9gration (MIFI, provincial).<\/p><p class=\"p1\">En outre, pour les emplois soumis \u00e0 une EIMT, l\u2019employeur doit remettre au futur salari\u00e9 \u00e9tranger <strong><a href=\"https:\/\/ircc.canada.ca\/francais\/centre-aide\/reponse.asp?qnum=1200&amp;top=17\" target=\"_blank\" rel=\"noopener\">une lettre d\u2019offre d\u2019emploi<\/a><\/strong>, d\u00fbment sign\u00e9e, et qui sera jointe au dossier. l\u2019employeur, pas du travailleur ;<\/li><li class=\"p1\">Confirmer que l\u2019agence a bel et bien fourni par \u00e9crit des informations concernant : le poste propos\u00e9, le salaire et les
