Celles-ci ont ainsi des droits dans les conditions d\u2019exercice de leur emploi, mais aussi des obligations.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-593b1be5 elementor-widget elementor-widget-text-editor\" data-id=\"593b1be5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Les personnes salari\u00e9es peuvent ainsi pr\u00e9tendre \u00e0 certains droits.<\/p><p>Parmi ces droits, on peut citer le <strong>droit \u00e0 un salaire,<\/strong> qui leur est garanti, tout comme le <strong>droit \u00e0 un horaire de travail incluant des pauses,<\/strong> des vacances annuelles, des jours f\u00e9ri\u00e9s, des cong\u00e9s pour raison m\u00e9dicale et des cong\u00e9s pour obligations parentales ou familiales.<\/p><p>Tous les salari\u00e9s ont aussi <strong>droit \u00e0 un environnement de travail libre de toute forme de harc\u00e8lement psychologique ou sexuel<\/strong>, et l\u2019employeur est tenu de s\u2019en assurer.<\/p><p>Dans le cas d\u2019une rupture de contrat (licenciement, mises \u00e0 pied, cong\u00e9diement ou d\u00e9mission), le travailleur a le <strong>droit de percevoir toutes les sommes qui lui sont dues. <\/strong><\/p><p>En cas de non-respect de ses droits, un travailleur peut effectuer un recours aupr\u00e8s de la CNESST.<\/p><p>Ces droits sont assortis d\u2019un certain nombre d\u2019obligations, \u00e0 commencer par le respect du contrat de travail. Le travailleur est \u00e9galement tenu d\u2019aviser son employeur le plus rapidement possible s\u2019il doit s\u2019absenter, pour des raisons de sant\u00e9 ou par obligations parentales ou forc\u00e9 \u00e0 travailler ou \u00e0 rester avec un employeur, m\u00eame si, en cas de permis de travail li\u00e9 \u00e0 votre employeur, quitter ce dernier vous oblige \u00e0 trouver un nouvel employeur pr\u00eat \u00e0 r\u00e9aliser les d\u00e9marches en vue d\u2019obtenir un nouveau permis de travail.<\/li><li class=\"p1\"><strong>Vous avez droit \u00e0 un salaire \u00e9quitable.<\/strong> Au minimum, le salaire pr\u00e9vu dans votre permis de travail ou dans l\u2019offre d\u2019emploi valid\u00e9e par le gouvernement.<\/li><li class=\"p1\"><strong>Vos documents sont \u00e0 vous :<\/strong> aucune agence ni employeur ne peut garder votre passeport ou permis de travail.<\/li><li class=\"p1\"><strong>Vous avez droit \u00e0 un logement d\u00e9cent.<\/strong> Si le logement est fourni par votre employeur, il doit respecter les normes minimales (hygi\u00e8ne et s\u00e9curit\u00e9, notamment).<\/li><li class=\"p1\"><strong>Acc\u00e8s aux soins :<\/strong> en tant que TET, vous \u00eates admissible \u00e0 la R\u00e9gie de l\u2019assurance maladie du Qu\u00e9bec (RAMQ). Plusieurs mesures vont dans ce sens, notamment :<\/p><ul><li>Les employeurs doivent informer les travailleurs \u00e9trangers temporaires de leurs droits \u00ab au plus tard le premier jour de travail \u00bb ;<\/li><li>Un contrat de travail doit \u00eatre remis au plus tard le premier jour d\u2019emploi. Le contrat doit proposer le m\u00eame salaire et les m\u00eames conditions que l\u2019offre d\u2019emploi, en plus de correspondre au march\u00e9 ;<\/li><li>Les repr\u00e9sailles des employeurs sont interdites ;<\/li><li>Les travailleurs ne doivent pas payer les frais li\u00e9s au recrutement, \u00e0 l\u2019EIMT, ou autre \u00e0 leur employeur ou \u00e0 un tiers. Seuls sont \u00e0 leur charge les frais de visa, de permis de travail ou de r\u00e9sidence ;<\/li><li>Si l\u2019employ\u00e9 tombe malade ou se blesse, l\u2019employeur doit l\u2019aider \u00e0 acc\u00e9der \u00e0 des soins de sant\u00e9. Celle-ci est actuellement fix\u00e9e \u00e0 <strong>10 % des effectifs totaux par lieux de travail. <\/strong><\/p><p>De plus, les TET embauch\u00e9s dans le volet bas salaire ne peuvent pr\u00e9tendre qu\u2019\u00e0 un permis de travail d\u2019une dur\u00e9e d\u2019un an.<\/p><p>Deux autres mesures temporaires en vigueur <strong>emp\u00eachent tout simplement l\u2019embauche<\/strong> de TET \u00e0 bas salaire \u2014 <strong>ou le renouvellement d\u2019un permis de travail<\/strong> d\u2019un TET qui serait toujours inf\u00e9rieur au salaire m\u00e9dian :<\/p><p>\u2022 Une mesure f\u00e9d\u00e9rale prive les R\u00e9gions m\u00e9tropolitaines de recensement (RMR) dont le taux de ch\u00f4mage est \u00e9gal ou sup\u00e9rieur \u00e0 6 % ;<\/p><p>\u2022 Une mesure provinciale interdit aux entreprises \u00e9tablies sur les \u00eeles de Montr\u00e9al et de Laval d\u2019embaucher des TET \u00e0 bas salaire.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Droits et obligations de la personne salari\u00e9e Au Qu\u00e9bec, la loi encadre les conditions de travail de la plupart des personnes salari\u00e9es, \u00e0 temps plein ou \u00e0 temps partiel.
