Le pourboire est un montant en sus du prix de vente, qu\u2019un client verse en appr\u00e9ciation du service qui lui a \u00e9t\u00e9 rendu et qui s\u2019ajoute au salaire habituel de la personne salari\u00e9e. Il peut lui \u00eatre vers\u00e9 soit directement, soit indirectement, par exemple dans les cas o\u00f9 l\u2019employeur encaisse le pourboire en m\u00eame temps que la facture, ou encore lorsqu\u2019existe une convention de partage des pourboires entre les employ\u00e9s. D\u2019autres cas peuvent se pr\u00e9senter, pour les personnes qui travaillent <a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/conditions-travail\/salaire-paye\/salaire\/salaire-piece\" target=\"_blank\" rel=\"noopener\"><strong>\u00e0 la pi\u00e8ce<\/strong><\/a> ou <a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/conditions-travail\/salaire-paye\/salaire\/salaire-commission\" target=\"_blank\" rel=\"noopener\"><strong>\u00e0 la commission<\/strong><\/a>. Le travailleur n\u2019est pas non plus r\u00e9mun\u00e9r\u00e9 pour sa pause-repas, \u00e0 moins qu\u2019ils doivent la passer \u00e0 son poste de travail. Par ailleurs, certains types de travailleurs sont aussi exclus de la norme sur le salaire minimum :<\/p><ul><li class=\"p1\">Les employ\u00e9s d\u2019un organisme \u00e0 but non lucratif ;<\/li><li class=\"p1\">Les stagiaires (encadr\u00e9s par une formation professionnelle reconnue l\u00e9galement) ;<\/li><li class=\"p1\">Les salari\u00e9s pay\u00e9s enti\u00e8rement \u00e0 la commission, travaillant \u00e0 l\u2019ext\u00e9rieur de l\u2019\u00e9tablissement avec des heures de travail incontr\u00f4lables.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-e58a161 e-con-full e-flex e-con e-parent\" data-id=\"e58a161\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-72cddee2 e-con-full e-flex e-con e-child\" data-id=\"72cddee2\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-5c823e5 elementor-widget elementor-widget-heading\" data-id=\"5c823e5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Le calcul du salaire<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-52241aab elementor-widget elementor-widget-text-editor\" data-id=\"52241aab\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Au Qu\u00e9bec, le calcul du salaire est g\u00e9n\u00e9ralement bas\u00e9 sur le syst\u00e8me de Classification nationale des professions (CNP), d\u00e8s lors que les grilles salariales ne sont pas pr\u00e9vues dans le cadre d\u2019une entente de type convention collective.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-69405331 elementor-widget elementor-widget-text-editor\" data-id=\"69405331\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Pour la plupart des travailleurs et des travailleuses, le syst\u00e8me de <strong>Classification nationale des professions<\/strong> (CNP) est la r\u00e9f\u00e9rence canadienne pour obtenir des indications sur les \u00e9chelles salariales des diff\u00e9rentes professions. Les donn\u00e9es statistiques de la CNP sont mises \u00e0 jour tous les cinq ans, et contiennent des informations sur les conditions d\u2019acc\u00e8s \u00e0 un emploi et les t\u00e2ches qui y sont associ\u00e9es.<\/p><p><strong>La CNP est au c\u0153ur de l\u2019embauche de travailleurs \u00e9trangers temporaires<\/strong>, car elle va permettre de d\u00e9terminer la cat\u00e9gorie de l\u2019emploi de m\u00eame que le niveau de salaire associ\u00e9 au poste recherch\u00e9. Une convention collective remplace les contrats individuels, et d\u00e9coule d\u2019une entente entre employeur et syndicat. Les entreprises utilisent ensuite ce taux comme r\u00e9f\u00e9rence pour \u00e9tablir leur propre politique salariale. Toutefois, il s\u2019agit de garder \u00e0 l\u2019esprit que :<\/p><ul><li>L\u2019augmentation n\u2019est pas obligatoire ;<\/li><li>Le travailleur pay\u00e9 au salaire minimum doit \u00eatre augment\u00e9 en fonction de la r\u00e9vision annuelle du salaire minimum. data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Dans certains cas particuliers, des d\u00e9ductions et retenues peuvent \u00eatre op\u00e9r\u00e9es sur le salaire brut, directement \u00e0 la source. Si la plupart doivent donner lieu \u00e0 l\u2019autorisation \u00e9crite pr\u00e9alable du salari\u00e9, certaines s\u2019appliquent de plein droit.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9e970d0 elementor-widget elementor-widget-text-editor\" data-id=\"9e970d0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>L\u2019employeur n\u2019est autoris\u00e9 \u00e0 effectuer une retenue ou une d\u00e9duction sur la paye que dans de rares cas, tr\u00e8s encadr\u00e9s et essentiellement pour remplir une obligation fix\u00e9e par :<\/p><ul><li>La loi \u2014 comme c\u2019est le cas des imp\u00f4ts, qui sont retenus \u00e0 la source au Canada ;<\/li><li>Un r\u00e8glement, une ordonnance judiciaire ;<\/li><li>Une convention collective ;<\/li><li>Un d\u00e9cret ;<\/li><li>Un r\u00e9gime compl\u00e9mentaire de sant\u00e9 ou de retraite dont l\u2019adh\u00e9sion est obligatoire pour les salari\u00e9s.<\/li><\/ul><p>Dans tous les autres cas, il ne peut y avoir retenue sans l\u2019autorisation \u00e9crite de la travailleuse ou du travailleur (raison de la retenue, montant, dur\u00e9e et fr\u00e9quence, autres).<\/p><p>Deux exceptions subsistent dans les- quelles une retenue peut \u00eatre op\u00e9r\u00e9e sans l\u2019autorisation \u00e9crite du travailleur :<\/p><ul><li>La premi\u00e8re exception est celle du <strong>R\u00e9gime volontaire d\u2019\u00e9pargne-retraite<\/strong>, dans les entreprises qui remplissent les crit\u00e8res l\u2019obligeant \u00e0 la mise en place d\u2019un tel r\u00e9gime. L\u2019inscription des travailleuses et des travailleurs \u00e9tant automatique \u2014 m\u00eame si ces derniers peuvent faire le choix de se retirer du r\u00e9gime.<\/li><li>La seconde exception est celle des <a href=\"http:\/\/-\thttps:\/\/www.cnesst.gouv.qc.ca\/fr\/conditions-travail\/salaire-paye\/paye\/frais-repas-dhebergement\" data-wplink-url-error=\"true\"><strong>frais de repas et d\u2019h\u00e9bergement<\/strong><\/a> (hors aide familiale domestique qui habite et prend ses repas chez lui), d\u00e8s lors que les conditions de retenue sont remplies.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c205448 elementor-position-inline-start elementor-mobile-position-inline-start charge de l\u2019employeur \u2014 et ne peuvent donc pas faire l\u2019objet de retenues sur salaire.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3e76348c elementor-widget elementor-widget-text-editor\" data-id=\"3e76348c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Deux grandes cat\u00e9gories de frais peuvent, selon les cas, demeurer \u00e0 la charge de l\u2019employeur :<\/p><ul><li>Les frais d\u2019acquisition et d\u2019entretien d\u2019un v\u00eatement ou d\u2019un uniforme de travail ;<\/li><li>Les frais li\u00e9s \u00e0 l\u2019achat de mat\u00e9riel, d\u2019\u00e9quipement\/outils ou de marchandises obligatoires.<\/li><\/ul><p><strong>Pour que ces frais rel\u00e8vent de la responsabilit\u00e9 de l\u2019employeur, le salari\u00e9 doit \u00eatre r\u00e9mun\u00e9r\u00e9 au salaire minimum<\/strong>. Si le salari\u00e9 est pay\u00e9 davantage, il peut \u00eatre mis \u00e0 contribution pour tout ou partie de ces frais, dans la limite du prix pay\u00e9 pour l\u2019achat ou l\u2019entretien du v\u00eatement ou de l\u2019\u00e9quipe- ment, mais seulement dans la mesure o\u00f9 son salaire demeure \u00e9gal ou sup\u00e9rieur au salaire minimum.<\/p><p><strong>Dans le cas du v\u00eatement\/uniforme de travail, il existe deux exceptions<\/strong> :<\/p><ul><li>Le v\u00eatement qui identifie l\u2019entreprise doit \u00eatre fourni gratuitement par l\u2019employeur, sans consid\u00e9ration de salaire ;<\/li><li>L\u2019employeur ne peut obliger ses employ\u00e9s \u00e0 acheter des v\u00eatements qu\u2019il vend lui-m\u00eame.<\/li><\/ul><p>Dans le cas de l\u2019achat de mat\u00e9riel\/\u00e9quipement, aucune retenue sur salaire ne peut \u00eatre r\u00e9alis\u00e9e sans autorisation pr\u00e9alable du travailleur.<\/p><p>Si l\u2019employeur fournit lui-m\u00eame l\u2019\u00e9quipement, il doit s\u2019assurer que celui-ci r\u00e9ponde aux normes de s\u00e9curit\u00e9 en vigueur.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element mise \u00e0 disposition gratuite ou non du logement par l\u2019employeur au TET n\u2019est pas toujours obligatoire, comme c\u2019est le cas dans le cadre du PTAS ou du Volet agricole du PTET.<\/p><p class=\"p1\">Dans le cas du volet bas salaire du PTET, l\u2019employeur peut avoir des obligations en mati\u00e8re de logement au TET si ce dernier est recrut\u00e9 dans une r\u00e9gion \u00e9loign\u00e9e ou rurale, o\u00f9 peu de logements sont disponibles.<\/p><p class=\"p1\">Emploi et D\u00e9veloppement social Canada (EDSC) exige de l\u2019employeur qu\u2019il offre au TET bas salaire un logement convenable et abordable, ou au moins s\u2019assurer qu\u2019un tel logement est \u00e0 la disposition du TET.
