Mais des conditions s\u2019appliquent, selon les cas.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3bc63ef6 elementor-widget elementor-widget-text-editor\" data-id=\"3bc63ef6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Selon les cas, la personne salari\u00e9e peut s\u2019absenter de son emploi, sans salaire :<\/p><ul><li><strong>Jusqu\u2019\u00e0 26 semaines par p\u00e9riode de 12 mois<\/strong> en cas de maladie, si elle est victime d\u2019un accident, de violence conjugale ou \u00e0 caract\u00e8re sexuel, ou encore si elle effectue un don d\u2019organes ou de tissus.<\/li><li><strong>Jusqu\u2019\u00e0 104 semaines<\/strong> si la personne est bless\u00e9e gravement \u00e0 la suite d\u2019un acte criminel dont elle est la victime, ou si elle est bless\u00e9e lors d\u2019une intervention l\u00e9gale destin\u00e9e \u00e0 pr\u00e9venir un acte criminel.<\/li><\/ul><p>En cas d\u2019absence pour l\u2019un ou l\u2019autre de ces motifs, la LNT pr\u00e9voit qu\u2019un minimum de deux jours par ann\u00e9e civile sont r\u00e9mun\u00e9r\u00e9s.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-59edf7c e-con-full e-flex e-con e-parent\" data-id=\"59edf7c\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-f55d3fc e-con-full e-flex e-con e-child\" data-id=\"f55d3fc\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-a29b6a1 elementor-widget elementor-widget-heading\" data-id=\"a29b6a1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Les conditions entourant les absences pour maladie<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b402bbc elementor-widget elementor-widget-text-editor\" data-id=\"b402bbc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Les absences pour maladie et celles pour raisons familiales ou parentales partagent un certain nombre de caract\u00e9ristiques communes.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-61f292e elementor-widget elementor-widget-text-editor\" data-id=\"61f292e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li>Pour b\u00e9n\u00e9ficier des deux journ\u00e9es d\u2019absence r\u00e9mun\u00e9r\u00e9es par ann\u00e9e, l\u2019employ\u00e9 doit avoir compl\u00e9t\u00e9 trois mois de service continu.<\/li><li>Ces journ\u00e9es ne peuvent pas \u00eatre report\u00e9es \u00e0 une ann\u00e9e ult\u00e9rieure ni remplac\u00e9es pas une indemnit\u00e9 financi\u00e8re.<\/li><li>La convention collective ou la politique interne de l\u2019entreprise peuvent pr\u00e9voir un nombre plus \u00e9lev\u00e9 de jours d\u2019absence pay\u00e9s que le minimum pr\u00e9vu par la LNT.<\/li><li>Si l\u2019absence d\u00e9coule d\u2019une maladie professionnelle ou d\u2019un accident de travail, le salari\u00e9 est couvert par le r\u00e9gime de sant\u00e9 et de s\u00e9curit\u00e9 du travail (SST) de la CNESST. De plus, son retour en emploi peut faire l\u2019objet d\u2019am\u00e9nagements.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-772ff30 elementor-widget elementor-widget-text-editor\" data-id=\"772ff30\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>En principe, \u00e0 son retour d\u2019absence, le salari\u00e9 a le droit de r\u00e9int\u00e9grer son poste habituel, selon les m\u00eames conditions que s\u2019il \u00e9tait rest\u00e9 au travail. Si son poste n\u2019existe plus \u00e0 son retour, elle conserve pour autant tous ses droits et privil\u00e8ges.<\/p><p>Si l\u2019absence d\u00e9coule d\u2019une atteinte corporelle grave r\u00e9sultant d\u2019un acte criminel, le salari\u00e9 peut effectuer un retour au travail \u00e0 temps partiel ou de mani\u00e8re intermittente, en accord avec son employeur et pour la dur\u00e9e pr\u00e9vue de son absence.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-867eec5 elementor-position-inline-start elementor-mobile-position-inline-start un document justificatif d\u2019absence pour raison m\u00e9dicale, par exemple un certificat du m\u00e9decin :<\/p><ul><li class=\"p2\"><span class=\"s1\">\u00c0 partir de la quatri\u00e8me p\u00e9riode d\u2019absence de trois jours cons\u00e9cutifs ou moins, au cours <\/span><span class=\"s1\">d\u2019une p\u00e9riode de 12 mois ;<\/span><\/li><li class=\"p2\"><span class=\"s1\">D\u00e8s qu\u2019une absence d\u00e9passe trois jours cons\u00e9cutifs, m\u00eame si c\u2019est la premi\u00e8re absence \u00e0 <\/span><span class=\"s1\">l\u2019int\u00e9rieur de ces 12 mois.<\/span><\/li><\/ul><p class=\"p2\"><span class=\"s1\">En revanche, pour les trois premi\u00e8res absences courtes (jusqu\u2019\u00e0 3 jours cons\u00e9cutifs chacune) <\/span><span class=\"s1\">dans une p\u00e9riode de 12 mois, l\u2019employeur ne peut pas exiger de certificat
