{"id":23262,"date":"2025-11-28T12:03:34","date_gmt":"2025-11-28T17:03:34","guid":{"rendered":"https:\/\/immigrantquebec.com\/fr\/?post_type=guide&#038;p=23262"},"modified":"2026-01-08T15:08:44","modified_gmt":"2026-01-08T20:08:44","slug":"les-plaintes-en-equite-salariale","status":"publish","type":"guide","link":"https:\/\/immigrantquebec.com\/fr\/guide-cnesst\/les-plaintes-en-equite-salariale\/","title":{"rendered":"Les plaintes en \u00e9quit\u00e9 salariale"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"23262\" class=\"elementor elementor-23262\" data-elementor-post-type=\"guide\">\n\t\t\t\t<div class=\"elementor-element elementor-element-d386902 e-con-full e-flex e-con e-parent\" data-id=\"d386902\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-334a762d e-con-full e-flex e-con e-child\" data-id=\"334a762d\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-39bc935d elementor-widget elementor-widget-heading\" data-id=\"39bc935d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Les plaintes sur les travaux d\u2019\u00e9quit\u00e9 salariale<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3d91ca90 elementor-widget elementor-widget-text-editor\" data-id=\"3d91ca90\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Plusieurs voies de recours sont ouvertes au salari\u00e9 qui constate des manquements durant les travaux d\u2019\u00e9quit\u00e9 salariale, notamment s\u2019ils n\u2019ont pas \u00e9t\u00e9 men\u00e9s alors qu\u2019ils auraient d\u00fb l\u2019\u00eatre.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-553e9aaf elementor-widget elementor-widget-text-editor\" data-id=\"553e9aaf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Si le salari\u00e9 estime que ses droits ne sont pas appliqu\u00e9s ou respect\u00e9s, <strong>il est possible de d\u00e9poser une plainte confidentielle sur l\u2019exercice initial, r\u00e9alis\u00e9 ou non, l\u2019\u00e9valuation du maintien de l\u2019\u00e9quit\u00e9 salariale, des repr\u00e9sailles subies de la part de l\u2019employeur, ou encore une conduite interdite. <\/strong><\/p><p>Si l\u2019entreprise n\u2019a tout simplement pas r\u00e9alis\u00e9 ses travaux dans le d\u00e9lai pr\u00e9vu par la loi, soit dans les quatre ans suivant l\u2019ann\u00e9e durant laquelle elle a compt\u00e9 10 salari\u00e9s en moyenne, alors qu\u2019il en avait l\u2019obligation, une plainte peut \u00eatre d\u00e9pos\u00e9e \u00e0 la CNESST en tout temps.<\/p><p>Les travailleurs et travailleuses peuvent \u00e9galement porter plainte si les travaux d\u2019\u00e9quit\u00e9 salariale n\u2019ont pas \u00e9t\u00e9 r\u00e9alis\u00e9s de mani\u00e8re conforme \u00e0 la loi.<\/p><p>Enfin, le d\u00e9p\u00f4t d\u2019une plainte est aussi possible si l\u2019employeur n\u2019a pas pay\u00e9 les ajustements salariaux dus aux travailleurs et travailleuses concern\u00e9s, ou encore que l\u2019\u00e9valuation du maintien de l\u2019\u00e9quit\u00e9 salariale n\u2019est pas respect\u00e9e \u2014 d\u00e8s lors, dans ce dernier cas, que l\u2019entreprise ne dispose pas d\u2019un comit\u00e9 d\u2019\u00e9quit\u00e9 salariale. Il est possible de se faire repr\u00e9senter par une entreprise, une firme ou une autre personne.<\/p><p><span style=\"text-decoration: underline;\"><strong>ATTENTION :<\/strong><\/span> Les assujettie \u00e0 la Loi sur l\u2019\u00e9quit\u00e9 salariale et que vous croyez que vos droits relatifs \u00e0 l\u2019\u00e9quit\u00e9 salariale ne sont pas respect\u00e9s, vous pouvez porter plainte en vertu de l\u2019article 19 de la Charte des droits et libert\u00e9s de la personne.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div Loi sur l\u2019\u00e9quit\u00e9 salariale peuvent d\u00e9poser une plainte.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fc5a482 elementor-widget elementor-widget-text-editor\" data-id=\"fc5a482\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Les travailleurs et travailleuses qui ont exerc\u00e9 un droit relatif \u00e0 la Loi sur l\u2019\u00e9quit\u00e9 salariale peuvent s\u2019exposer \u00e0 des repr\u00e9sailles de la part de leur employeur.<\/p><p>Le travailleur ou la travailleuse qui a subi des menaces, une diminution de salaire ou un cong\u00e9diement apr\u00e8s avoir d\u00e9pos\u00e9 plainte, par exemple, des recours sont possibles.<\/p><p>La plainte doit \u00eatre d\u00e9pos\u00e9e <strong>dans les 30 jours<\/strong> suivant les repr\u00e9sailles.<\/p><p>Il est possible de se faire repr\u00e9senter en mandatant une entreprise, une firme ou une autre personne. Les personnes syndiqu\u00e9es peuvent faire appel au syndicat.<\/p><p>La CNESST analysera la plainte et si elle est accept\u00e9e, elle s\u2019adressera au Tribunal administratif du travail.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-bddd224 e-con-full e-flex e-con e-parent\" data-id=\"bddd224\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\"><strong>Si le salari\u00e9 estime avoir subi une conduite interdite durant les travaux d\u2019\u00e9quit\u00e9 salariale, il peut d\u00e9poser une plainte.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bc8eaaf elementor-widget elementor-widget-text-editor\" data-id=\"bc8eaaf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Durant la r\u00e9alisation des travaux d\u2019\u00e9quit\u00e9 salariale, l\u2019employeur, l\u2019association accr\u00e9dit\u00e9e ou les membres d\u2019un comit\u00e9 peuvent commettre des actes interdits par la Loi sur l\u2019\u00e9quit\u00e9 salariale.\u00a0<\/p><p class=\"p1\">La conduite interdite peut \u00eatre :\u00a0<\/p><p class=\"p1\">\u2022 Un acte de mauvaise foi, comme la volont\u00e9 de faire barrage aux objectifs de la loi ;\u00a0<\/p><p class=\"p1\">\u2022 Un acte arbitraire, qui s\u2019apparente \u00e0 un traitement superficiel ou insouciant ;\u00a0<\/p><p class=\"p1\">\u2022 Un acte discriminatoire (intentionnel ou non) ;\u00a0<\/p><p class=\"p1\">\u2022 Une n\u00e9gligence grave, c\u2019est-\u00e0-dire une faute sans intention de nuire \u00e0 quelqu\u2019un.\u00a0<\/p><p class=\"p1\">Ce sont des actes jug\u00e9s d\u00e9raisonnables ou injustifiables qui ont pour effet d\u2019\u00e9carter les travaux des objectifs de la loi.<\/p><p class=\"p1\">Pour d\u00e9poser plainte, ces conduites doivent avoir \u00e9t\u00e9 r\u00e9alis\u00e9es durant l\u2019exercice initial ou l\u2019\u00e9valuation du maintien.<\/p><p class=\"p1\"><strong>La plainte doit \u00eatre d\u00e9pos\u00e9e dans les 60 jours<\/strong> suivant le manquement ou la date de prise de connaissance du manquement par le salari\u00e9, via le formulaire de plainte pour conduite interdite.<\/p><p class=\"p1\">Il est possible de mandater une entreprise, une firme ou une personne pour vous repr\u00e9senter dans le traitement de la plainte.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div
