La seule survenance d\u2019une douleur au travail ne peut constituer une l\u00e9sion professionnelle.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-78142b2c elementor-widget elementor-widget-text-editor\" data-id=\"78142b2c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Si un employ\u00e9 se blesse au travail, il doit :<\/p><p style=\"padding-left: 40px;\">1 &#8211; Aviser d\u00e8s que possible son sup\u00e9rieur ou un repr\u00e9sentant de l\u2019employeur ;<\/p><p style=\"padding-left: 40px;\">2 &#8211; Consulter imm\u00e9diatement un professionnel de la sant\u00e9 qui a charge, afin de recevoir les soins m\u00e9dicaux et demander une attestation \u00e0 ce dernier ;<\/p><p style=\"padding-left: 40px;\">3 &#8211; Respecter les consignes du professionnel de la sant\u00e9 qui a charge, ainsi que la date de retour au travail, s\u2019il y a lieu ;<\/p><p style=\"padding-left: 40px;\">4 &#8211; Remettre une copie de l\u2019attestation m\u00e9dicale \u00e0 son employeur ;<\/p><p style=\"padding-left: 40px;\">5 &#8211; Remplir la r\u00e9clamation du travailleur pour recevoir le remboursement de certains frais, et demander des indemnit\u00e9s s\u2019il doit s\u2019absenter du travail pendant plus de 14 jours ou s\u2019il doit recevoir des soins ou des traitements m\u00e9dicaux ;<\/p><p style=\"padding-left: 40px;\">6 &#8211; Passer les examens m\u00e9dicaux recommand\u00e9s par le professionnel de sant\u00e9 qui a charge ;<\/p><p style=\"padding-left: 40px;\">7 &#8211; Suivre tous les traitements prescrits par le m\u00e9decin ;<\/p><p style=\"padding-left: 40px;\">8 &#8211; Passer les \u00e9valuations m\u00e9dicales demand\u00e9es par la CNESST ou par l\u2019employeur, s\u2019il y a lieu ;<\/p><p style=\"padding-left: 40px;\">9 &#8211; Aviser la CNESST de tout changement survenu \u00e0 son \u00e9tat de sant\u00e9.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-57d5c61b Dans le cas d\u2019une l\u00e9sion professionnelle r\u00e9sultant de la violence \u00e0 caract\u00e8re sexuel, il dispose de deux ans pour le faire.<br \/><br \/><\/li><li class=\"p1\">Le salari\u00e9 a le droit de choisir son professionnel de la sant\u00e9 et l\u2019\u00e9tablissement dans lequel il sera soign\u00e9.<br \/><br \/><\/li><li class=\"p1\">Le salari\u00e9 a le droit de reprendre son emploi ou un emploi \u00e9quivalent d\u00e8s qu\u2019il est reconnu apte \u00e0 travailler. Pour faciliter son retour, l\u2019employeur pourrait lui assigner temporairement un travail diff\u00e9rent, lui donner acc\u00e8s \u00e0 des mesures de r\u00e9adaptation, etc.<br \/><br \/><\/li><li class=\"p1\">L\u2019employeur ne peut pas refuser de r\u00e9int\u00e9grer un employ\u00e9 \u00e0 un travail ou lui faire subir une sanction, une mesure discriminatoire ou des repr\u00e9sailles \u00e0 une demande de son employeur :<\/p><ul><li class=\"p1\"><strong>Le droit de refuser d\u2019accomplir une t\u00e2che<\/strong>, s\u2019ils estiment que cette t\u00e2che repr\u00e9sente un danger pour leur s\u00e9curit\u00e9 ou celle des autres ;<\/li><li class=\"p1\"><strong>Le droit de refuser travailler<\/strong> au-del\u00e0 de 50 heures par semaine, plus de 14 heures par jour, 2 heures au-del\u00e0 de ses heures quotidiennes habituelles de travail, ou lorsqu\u2019il n\u2019a pas \u00e9t\u00e9 inform\u00e9 au moins 5 jours \u00e0 l\u2019avance qu\u2019il serait requis de travailler.<\/li><\/ul><p class=\"p1\">Attention, dans les deux cas, des exceptions existent.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-10a0cf7a data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>La maladie professionnelle est une maladie caus\u00e9e par le travail, soit par l\u2019environnement de travail (par exemple, un environnement bruyant) ou par les t\u00e2ches li\u00e9es \u00e0 celui-ci (par exemple, la r\u00e9p\u00e9tition d\u2019un geste identique sur une longue p\u00e9riode, avec de tr\u00e8s courtes p\u00e9riodes de r\u00e9cup\u00e9ration).<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7707b3d elementor-widget elementor-widget-text-editor\" data-id=\"7707b3d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Si un employ\u00e9 croit \u00eatre atteint d\u2019une maladie professionnelle, il doit :<\/p><p style=\"padding-left: 40px;\">1 &#8211; Consulter un professionnel de la sant\u00e9 qui a charge, et recevoir une attestation situation m\u00e9dicale ;<\/p><p style=\"padding-left: 40px;\">4 &#8211; Passer les examens m\u00e9dicaux demand\u00e9s ;<\/p><p style=\"padding-left: 40px;\">5 &#8211; Suivre tous les traitements prescrits par le professionnel de la sant\u00e9 qui a charge ;<\/p><p style=\"padding-left: 40px;\">6 &#8211; Passer les \u00e9valuations m\u00e9dicales demand\u00e9es par la CNESST ou par l\u2019employeur, s\u2019il y a lieu ;<\/p><p style=\"padding-left: 40px;\">7 &#8211; Suivre la proc\u00e9dure d\u00e9termin\u00e9e par la CNESST.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div travailleurs \u00e9trangers temporaires.
