Avant de se lancer dans ce processus, il est important de commencer par s\u2019assurer que la situation v\u00e9cue justifie le d\u00e9p\u00f4t d\u2019une plainte.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6ea1145d elementor-widget elementor-widget-text-editor\" data-id=\"6ea1145d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Les salari\u00e9s peuvent d\u00e9poser une plainte s\u2019ils :<\/p><ul><li>Croient que leurs droits (ou que les lois que fait appliquer la CNESST) ne sont pas respect\u00e9s dans leur milieu de travail ;<\/li><li>Veulent signaler une situation dangereuse en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 ;<\/li><li>Souhaitent contester un processus contractuel ;<\/li><li>Sont insatisfaits des services rendus (ou non) par la CNESST ;<\/li><li>D\u00e9sirent contester une assignation temporaire ou une d\u00e9cision de la CNESST.<\/li><\/ul><p>Les plaintes peuvent \u00eatre en lien notamment avec :<\/p><ul><li><strong>Les normes du travail<\/strong> (salaire impay\u00e9, heures suppl\u00e9mentaires impay\u00e9es, cong\u00e9diement sans raison valable, harc\u00e8lement psychologique ou sexuel, pratiques interdites, etc.) ;<\/li><li><strong>L\u2019\u00e9quit\u00e9 salariale<\/strong> (travaux d\u2019\u00e9quit\u00e9 salariale non effectu\u00e9s ou effectu\u00e9s incorrectement, ajustements salariaux impay\u00e9s, etc.) ;<\/li><li><strong>La sant\u00e9 et la s\u00e9curit\u00e9 au travail<\/strong> (cons\u00e9quences n\u00e9gatives de l\u2019employeur (cong\u00e9diement, suspension, repr\u00e9sailles, etc.) apr\u00e8s une l\u00e9sion professionnelle, l\u2019exercice d\u2019un droit reconnu par la Loi sur les accidents du travail et les maladies professionnelles (LATMP) ou l\u2019exercice d\u2019un droit reconnu dans le Programme Pour une maternit\u00e9 sans danger, etc.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7cfc94a2 elementor-position-inline-start indemnisation<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-670c271c elementor-widget elementor-widget-text-editor\" data-id=\"670c271c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">La fraude en indemnisation est un comportement malhonn\u00eate de la part d\u2019un travailleur ou d\u2019un employeur en lien avec un dossier de la CNESST. M\u00eame si cette d\u00e9marche peut sembler complexe, les outils en ligne de la CNESST permettent de bien se pr\u00e9parer.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-302fabb7 elementor-widget elementor-widget-text-editor\" data-id=\"302fabb7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Si l\u2019employ\u00e9 croit que la situation justifie le d\u00e9p\u00f4t d\u2019une plainte, voici ce qu\u2019il peut faire :<\/p><ul><li><strong>Noter tous les renseignements n\u00e9cessaires avant de d\u00e9poser la plainte<\/strong>, ce qui lui permettra d\u2019en expliquer pr\u00e9cis\u00e9ment l\u2019objet ;<\/li><li><strong>Pr\u00e9parer les documents \u00e0 joindre dans le cas d\u2019une plainte en normes du travail<\/strong> (bulletin de paye, horaire de travail ou d\u00e9tail des heures travaill\u00e9es, relev\u00e9 d\u2019emploi ou relev\u00e9 d\u2019imp\u00f4t, etc.) ;<\/li><li><strong>Demander \u00e0 rencontrer son employeur, si cela est possible<\/strong>, afin de clarifier la situation et tenter de r\u00e9gler le probl\u00e8me. Si cette d\u00e9marche n\u2019est pas concluante, il doit porter plainte.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-289ee70d
