L\u2019employ\u00e9 peut d\u00e9poser une plainte aupr\u00e8s de la CNESST s\u2019il pense que son employeur ne lui a pas pay\u00e9 un salaire ou d\u2019autres montants pr\u00e9vus par la loi.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4815ab5c elementor-widget elementor-widget-text-editor\" data-id=\"4815ab5c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Selon la Loi sur les normes du travail, la CNESST peut r\u00e9clamer, pour le compte du salari\u00e9, un salaire impay\u00e9 de l\u2019employeur ou d\u2019autres montants pr\u00e9vus par la loi, comme des heures suppl\u00e9mentaires, du temps de formation et de r\u00e9unions, des d\u00e9placements dans le cadre du travail, des indemnit\u00e9s de vacances, de jours f\u00e9ri\u00e9s ou de fin d\u2019emploi.<\/p><p>Un employ\u00e9 pourrait d\u00e9poser une plainte, par exemple, pour des heures suppl\u00e9mentaires impay\u00e9es, des journ\u00e9es de vacances non r\u00e9mun\u00e9r\u00e9es ou parce que son salaire est inf\u00e9rieur \u00e0 celui d\u2019un coll\u00e8gue qui effectue les m\u00eames t\u00e2ches dans le m\u00eame \u00e9tablissement, mais avec un statut d\u2019emploi diff\u00e9rent (temps partiel ou temps plein).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ecf025c elementor-widget elementor-widget-text-editor\" data-id=\"ecf025c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Si un employ\u00e9 croit qu\u2019il est victime de sanctions, de mesures discriminatoires ou de repr\u00e9sailles parce qu\u2019il a exerc\u00e9 un droit pr\u00e9vu \u00e0 la loi, il peut faire une plainte pour pratiques interdites, qui est li\u00e9e aux normes du travail.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5864361 elementor-widget elementor-widget-text-editor\" data-id=\"5864361\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Plusieurs pratiques interdites justifient une plainte aupr\u00e8s de la CNESST. Ce sera le cas, par exemple, de la personne salari\u00e9e a subi des sanctions, des mesures discriminatoires ou des repr\u00e9sailles parce qu\u2019elle :<\/p><ul><li>A annonc\u00e9 qu\u2019elle \u00e9tait enceinte<\/li><li>S\u2019est absent\u00e9e pour un cong\u00e9 de maternit\u00e9, de paternit\u00e9 ou un cong\u00e9 parental<\/li><li>S\u2019est absent\u00e9e pour un cong\u00e9 de maladie<\/li><li>Parle uniquement fran\u00e7ais, a des connaissances insuffisantes d\u2019une autre langue que le fran\u00e7ais, ou exige le respect d\u2019un droit pr\u00e9vu \u00e0 l\u2019article 45 de la Charte de la langue fran\u00e7aise. Dans ce cas, pour d\u00e9poser une plainte, il faut contacter le service \u00e0 la client\u00e8le au 1 844 838-0808 et s\u00e9lectionner l\u2019option Normes du travail.<\/li><li>S\u2019est absent\u00e9e pour remplir ses obligations parentales<\/li><li>A refus\u00e9 de travailler plus que ses heures habituelles pour remplir des obligations familiales<\/li><li>A fait un signalement concernant une conduite de harc\u00e8lement psychologique commise envers une autre personne ou a collabor\u00e9 au traitement d\u2019un signalement ou d\u2019une plainte portant sur une telle conduite.<\/li><\/ul><p><strong>D\u00e9lai pour d\u00e9poser une plainte : L\u2019employ\u00e9 a 45 jours apr\u00e8s le cong\u00e9diement ou la sanction. <\/strong><\/p><p>Si la personne a \u00e9t\u00e9 oblig\u00e9e de prendre sa retraite ou a re\u00e7u une sanction apr\u00e8s avoir refus\u00e9 une mise \u00e0 la retraite. Toutefois, si un conflit survient \u00e0 la suite d\u2019un licenciement, un cong\u00e9diement ou une mise \u00e0 pied et doit \u00eatre tranch\u00e9 par un juge, l\u2019employeur doit montrer que sa d\u00e9cision est fond\u00e9e sur des motifs justes et suffisants.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8b3c2ca d\u2019un travailleur si elle a des motifs de croire, \u00e0 la suite d\u2019une enqu\u00eate, qu\u2019un de ses droits conf\u00e9r\u00e9s par la loi n\u2019a pas \u00e9t\u00e9 respect\u00e9 ;<\/li><li class=\"p1\">Est en mesure, apr\u00e8s une activit\u00e9 de surveillance, d\u2019appliquer une sanction p\u00e9nale si un employeur est data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>La LNT interdit les disparit\u00e9s dans les conditions de travail, qui seraient uniquement dues \u00e0 la date d\u2019embauche de travailleuses et travailleurs.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8b4ac37 elementor-widget elementor-widget-text-editor\" data-id=\"8b4ac37\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>En principe, les travailleuses et travailleurs qui r\u00e9alisent les m\u00eames t\u00e2ches au sein du m\u00eame \u00e9tablissement <strong>ne peuvent pas se voir accorder de conditions de travail diff\u00e9rentes au seul motif qu\u2019ils ont \u00e9t\u00e9 embauch\u00e9s ant\u00e9rieurement ou ult\u00e9rieurement aux autres.<\/strong> Les personnes salari\u00e9es qui croient b\u00e9n\u00e9ficier de conditions de travail diff\u00e9rentes que celles de leurs coll\u00e8gues \u00e0 t\u00e2che \u00e9quivalente peuvent se pr\u00e9valoir des <a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/N-1.1#se:87_1\" target=\"_blank\" rel=\"noopener\"><strong>articles 87.1<\/strong><\/a> et <a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/N-1.1#se:87_2\" target=\"_blank\" rel=\"noopener\"><strong>87.2<\/strong><\/a> de la LNT.<\/p><p>Les conditions de travail vis\u00e9es
