Plusieurs m\u00e9canismes s\u2019offrent alors \u00e0 eux.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-51d66f90 elementor-widget elementor-widget-text-editor\" data-id=\"51d66f90\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>D\u00e8s lors qu\u2019une situation de harc\u00e8lement psychologique ou \u00e0 caract\u00e8re sexuel est av\u00e9r\u00e9e, le salari\u00e9 peut, selon les cas, prendre plusieurs actions.<\/p><p>Si un employ\u00e9 croit \u00eatre victime de harc\u00e8lement, il peut :<\/p><ul><li><strong>Parler de sa situation<\/strong> en informant son employeur ou son syndicat, si cela est possible ;<\/li><li><strong>Consulter son m\u00e9decin<\/strong> s\u2019il pense que sa sant\u00e9 physique ou psychologique est atteinte ou en danger ;<\/li><li><a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/service-clientele\/plaintes-recours\/situations-justifiant-depot-dune-plainte#Danger\" target=\"_blank\" rel=\"noopener\"><strong>Signaler la situation<\/strong><\/a> \u00e0 un inspecteur de la CNESST ;<\/li><li><a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/service-clientele\/plaintes-recours\/plaintes-en-normes-travail\/plainte-pour-harcelement-psychologique-sexuel\" target=\"_blank\" rel=\"noopener\"><strong>D\u00e9poser une plainte<\/strong><\/a> pour harc\u00e8lement psychologique ou sexuel au travail.<\/li><\/ul><p><strong>L\u2019employ\u00e9 a 2 ans apr\u00e8s le dernier \u00e9v\u00e9nement de harc\u00e8lement pour d\u00e9poser sa plainte.<\/strong> Il est aussi recommand\u00e9 de faire une r\u00e9clamation pour un accident du travail \u00e9galement si le harc\u00e8lement a conduit \u00e0 une l\u00e9sion psychologique ou physique attest\u00e9e par un m\u00e9decin.<\/p><p>Alternativement, et selon les cas, le salari\u00e9 peut aussi envisager de :<\/p><ul><li><a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/service-clientele\/plaintes-recours\/plaintes-recours-en-sante-securite-travail\/differend-avec-votre-employeur-en-matiere-sante\" target=\"_blank\" rel=\"noopener\"><strong>D\u00e9poser une plainte pour un diff\u00e9rend avec l\u2019employeur<\/strong><\/a> s\u2019il consid\u00e8re que son milieu de travail met \u00e0 risque sa sant\u00e9, sa s\u00e9curit\u00e9 ou son int\u00e9grit\u00e9 physique ou psychologique. Il peut aussi d\u00e9poser une plainte s\u2019il a \u00e9t\u00e9 cong\u00e9di\u00e9, suspendu ou a subi des repr\u00e9sailles apr\u00e8s avoir subi une l\u00e9sion professionnelle ou exerc\u00e9 une fonction ou un droit reconnu par la loi.<\/li><li><a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/service-clientele\/plaintes-recours\/plaintes-en-normes-travail\/plainte-pour-pratique-interdite\" target=\"_blank\" rel=\"noopener\"><strong> D\u00e9poser une plainte pour pratique interdite<\/strong><\/a><\/li><li><a href=\"https:\/\/www.cdpdj.qc.ca\/fr\" target=\"_blank\" rel=\"noopener\"><strong>D\u00e9poser une plainte aupr\u00e8s de la Commission des droits de la personne et des droits de la jeunesse<\/strong><\/a> s\u2019il s\u2019agit de harc\u00e8lement li\u00e9 \u00e0 un cas de discrimination prot\u00e9g\u00e9 par la <em>Charte des droits et libert\u00e9s de la personne.<\/em><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-69fe10b elementor-widget elementor-widget-text-editor\" data-id=\"69fe10b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Si un employ\u00e9 est t\u00e9moin de harc\u00e8lement, il doit signaler la situation :<\/p><ul><li>\u00c0 son employeur, au repr\u00e9sentant en sant\u00e9 et s\u00e9curit\u00e9, \u00e0 l\u2019agent de liaison en sant\u00e9 et s\u00e9curit\u00e9, aux membres du comit\u00e9 en sant\u00e9 et s\u00e9curit\u00e9, <br \/>ou<\/li><li>\u00c0 un inspecteur de la CNESST.<\/li><\/ul><p><strong><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/N-1.1#se:122\" target=\"_blank\" rel=\"noopener\">L\u2019article 122 de la Loi sur les normes du travail<\/a> prot\u00e8ge cet employ\u00e9 contre les repr\u00e9sailles.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-6e6bcf7f e-con-full e-flex e-con e-child\" data-id=\"6e6bcf7f\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-174c37e3 e-con-full e-flex e-con e-child\" data-id=\"174c37e3\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2eb9edfd elementor-widget elementor-widget-image\" data-id=\"2eb9edfd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img fetchpriority=\"high\" decoding=\"async\" width=\"512\" height=\"512\" src=\"https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir.png\" class=\"attachment-full size-full wp-image-22588\" alt=\"\" srcset=\"https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir.png 512w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-200x200.png 200w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-120x120.png 120w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-24x24.png 24w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-48x48.png 48w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-96x96.png 96w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-150x150.png 150w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-300x300.png 300w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-350x350.png 350w\" sizes=\"(max-width: 512px) 100vw, 512px\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-5a48a285 e-con-full e-flex e-con e-child\" data-id=\"5a48a285\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-3eb81125 elementor-widget elementor-widget-text-editor\" data-id=\"3eb81125\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Pour faire valoir ses droits, <strong>la personne salari\u00e9e syndiqu\u00e9e<\/strong> doit s\u2019adresser d\u2019abord directement \u00e0 son syndicat pour d\u00e9poser un grief. La convention collective pr\u00e9cise g\u00e9n\u00e9ralement la proc\u00e9dure \u00e0 suivre. Le d\u00e9lai minimal est toujours de deux ans, mais la convention peut en pr\u00e9voir un plus long. Le syndicat a le devoir de repr\u00e9sentation juste et objective envers ses membres (Art. 47.2 du Code du travail).<\/p><p class=\"p1\"><strong>Si la personne travaille pour la fonction publique non r\u00e9gie par une convention collective<\/strong>, y compris les membres et les dirigeants d\u2019un organisme, elle peut d\u00e9poser un recours aupr\u00e8s de la Commission de la fonction publique
