Il peut contester la rupture aupr\u00e8s de la CNESST, sous certaines conditions.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-20024547 peut mettre fin \u00e0 l\u2019emploi d\u2019une personne salari\u00e9e dans le cadre de l\u2019exercice de son droit de gestion, qui comprend notamment :<\/p><ul><li>L\u2019attribution des t\u00e2ches ;<\/li><li>La gestion du rendement du personnel, de la discipline, de la pr\u00e9sence\/des absences ;<\/li><li>La pr\u00e9vention du harc\u00e8lement psychologique et sexuel.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-178d187 elementor-position-inline-start elementor-mobile-position-inline-start dans le cas d\u2019un manquement d\u2019un employ\u00e9, appliquer des <strong>mesures disciplinaires de fa\u00e7on graduelle<\/strong> (ce que l\u2019on appelle la gradation des sanctions), qui peuvent \u00e9ventuellement mener \u00e0 un cong\u00e9diement.<\/p><p>Une <strong>faute grave<\/strong> de la part de l\u2019employ\u00e9 pourrait justifier la rupture imm\u00e9diate du lien d\u2019emploi.<\/p><p>Des motifs <strong>administratifs et \u00e9conomiques<\/strong> pourraient aussi invoqu\u00e9s, mais l\u2019employeur doit respecter certaines exigences.<\/p><p>Or, des situations peuvent \u00eatre consid\u00e9r\u00e9es comme un cong\u00e9diement sans cause juste et suffisante, par exemple :<\/p><ul><li><strong>Un cong\u00e9diement d\u00e9guis\u00e9<\/strong>, c\u2019est-\u00e0-dire que l\u2019employeur pr\u00e9sente la fin d\u2019emploi comme un licenciement ou une mise \u00e0 pied, par exemple en modifiant les conditions de travail de fa\u00e7on importante, poussant l\u2019employ\u00e9 \u00e0 d\u00e9missionner.<\/li><li><strong>Une double sanction<\/strong>, c\u2019est-\u00e0-dire qu\u2019il r\u00e9primande un travailleur deux fois pour le m\u00eame manquement, par exemple une suspension suivie d\u2019un cong\u00e9diement pour un m\u00eame \u00e9v\u00e9nement.<\/li><\/ul><p>Dans le cas d\u2019un cong\u00e9diement sans cause juste et suffisante, la personne salari\u00e9e peut d\u00e9poser une plainte aupr\u00e8s de la CNESST.<\/p><p>Des conditions doivent \u00eatre respect\u00e9es pour que la plainte soit recevable :<\/p><p>\u2022 La personne salari\u00e9e a occup\u00e9 l\u2019emploi pour le m\u00eame employeur sans interruption <strong>depuis au moins 2 ans<\/strong> ;<\/p><p>\u2022 La plainte doit \u00eatre <strong>d\u00e9pos\u00e9e dans les 45 jours<\/strong> apr\u00e8s la date de cong\u00e9diement.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ada6c97
