Pour tous les types de plaintes, il faut rassembler les \u00e9changes avec l\u2019employeur en rapport avec les faits relatifs \u00e0 la plainte, soit par courriel, message texte ou messagerie instantan\u00e9e via les r\u00e9seaux sociaux. Des preuves sp\u00e9cifiques relatives \u00e0 la plainte seront aussi \u00e0 fournir, comme un bulletin de paye, l\u2019horaire de travail d\u00e9taill\u00e9, des relev\u00e9s d\u2019emploi dans le cas d\u2019une plainte en normes du travail.<\/p><p>3. <a href=\"https:\/\/servicesenligne.cnesst.gouv.qc.ca\/plainteCNESST\" target=\"_blank\" rel=\"noopener\"><strong>D\u00e9poser la plainte<\/strong><\/a> gr\u00e2ce \u00e0 l\u2019outil en ligne :<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7ef52ac7 elementor-widget elementor-widget-text-editor\" data-id=\"7ef52ac7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Par la suite, la CNESST proc\u00e9dera ainsi \u00e0 :<\/p><p class=\"p1\">4. <strong>L\u2019analyse de la plainte<\/strong>, en communiquant avec le travailleur, afin de v\u00e9rifier si celle-ci est recevable ou non. Si la Commission peut donner suite \u00e0 la plainte, elle communiquera avec le travailleur et contactera l\u2019employeur pour expliquer les normes qui s\u2019appliquent et v\u00e9rifier si la m\u00e9sentente peut \u00eatre r\u00e9solue. Si ce n\u2019est pas le cas, la CNESST prendra d\u2019autres moyens pour trouver une solution, par exemple en ouvrant une enqu\u00eate. Si la CNESST ne peut donner suite \u00e0 la plainte, l\u2019employ\u00e9 aura 30 jours pour contester la d\u00e9cision en remplissant le <strong><a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/organisation\/documentation\/formulaires-publications\/demande-revision-decision-normes-travail\" target=\"_blank\" rel=\"noopener\">formulaire <em>Demande de r\u00e9vision de la d\u00e9cision<\/em><\/a><\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-90110bd elementor-widget elementor-widget-text-editor\" data-id=\"90110bd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">La CNESST aura, \u00e0 son tour, 30 jours pour y r\u00e9pondre.<\/p><p class=\"p1\">5. <strong>L\u2019offre d\u2019un service de m\u00e9diation<\/strong>, afin d\u2019aider les travailleurs et les employeurs \u00e0 trouver un accord. Les parties sont libres d\u2019accepter ou non la m\u00e9diation.<\/p><p class=\"p1\">6. <strong>La conduite d\u2019une enqu\u00eate<\/strong>, au besoin, pour v\u00e9rifier le bien-fond\u00e9 de la plainte. Si tel est le cas et qu\u2019il n\u2019y a aucune entente possible entre le travailleur et l\u2019employeur, la CNESST enverra, dans le cas d\u2019une plainte li\u00e9e au salaire, une r\u00e9clamation \u00e0 l\u2019employeur, qui disposera de dix jours pour payer. Si l\u2019employeur ne paie pas dans le d\u00e9lai pr\u00e9vu, le dossier sera transf\u00e9r\u00e9 aux affaires juridiques de la CNESST.<\/p><p class=\"p1\">7. <strong>Si la plainte est transf\u00e9r\u00e9e aux affaires juridiques<\/strong>, la personne qui a d\u00e9pos\u00e9 la plainte <strong><a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/organisation\/documentation\/formulaires-publications\/ma-plainte-pecuniaire-est-confiee-un-avocat\" target=\"_blank\" rel=\"noopener\">pourra se faire repr\u00e9senter sans frais<\/a><\/strong> par un avocat de la CNESST ou par l\u2019avocat de son choix en assumant les frais. Son syndicat pourra alors d\u00e9poser un grief en sa faveur pour une m\u00e9sentente en lien avec la convention collective ou une violation par l\u2019employeur d\u2019un ou des droits de l\u2019employ\u00e9 pr\u00e9vus par la loi.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-402a90e elementor-position-inline-start \u00e0 risque, plusieurs canaux sont ouverts.<\/p><p class=\"p1\">Les <strong>personnes salari\u00e9es non syndiqu\u00e9es<\/strong> soumises \u00e0 la Loi sur les normes du travail (y compris les cadres sup\u00e9rieurs) peuvent communiquer avec un inspecteur de garde de la CNESST, au <span>\u260e <\/span><strong>1 844 838-0808, option 1. <\/strong><\/p><p class=\"p1\">Les personnes <strong>salari\u00e9es syndiqu\u00e9es<\/strong> prendront contact avec leur syndicat.<\/p><p class=\"p1\">Les <strong>personnes salari\u00e9es de la fonction publique non r\u00e9gies par une convention collective<\/strong>, y compris les membres et les dirigeants d\u2019organismes, pourront s\u2019adresser \u00e0 la Commission de la fonction publique, au <span>\u260e <\/span><strong>1 418 643-1425<\/strong> (ailleurs au Qu\u00e9bec : <span>\u260e <\/span><strong>1 800 432-0432<\/strong>)<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Lors d\u2019une situation conflictuelle entre un employeur et un salari\u00e9 concernant, le dialogue est encourag\u00e9. La m\u00e9diation peut apporter une r\u00e9solution du conflit sans devoir traverser un processus judiciaire.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0fe928d elementor-widget elementor-widget-text-editor\" data-id=\"0fe928d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Avant d\u2019entamer une d\u00e9marche de plainte, il est conseill\u00e9 de tenter de trouver des solutions avec l\u2019employeur, si cela est possible.
