Il diff\u00e8re du cadre interm\u00e9diaire ou du gestionnaire en ce qu\u2019il participe aux d\u00e9cisions strat\u00e9giques et politiques avec un pouvoir d\u00e9cisionnel.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-11466f46 elementor-widget elementor-widget-text-editor\" data-id=\"11466f46\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Le cadre sup\u00e9rieur n\u2019a pas le m\u00eame statut qu\u2019un travailleur et, par cons\u00e9quent, il ne pourra pas se pr\u00e9valoir du cadre normatif de la m\u00eame fa\u00e7on.<\/p><p>En mati\u00e8re de normes, le cadre sup\u00e9rieur est \u00e9ligible :<\/p><ul><li>\u00c0 la retraite ;<\/li><li>Aux mesures qui rel\u00e8vent du harc\u00e8lement psychologique ;<\/li><li>Aux cong\u00e9s pour obligations familiales ou parentales.<\/li><\/ul><p>Ils sont exclus des lois sur l\u2019\u00e9quit\u00e9 salariale et sur la sant\u00e9 et la s\u00e9curit\u00e9 au travail.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3dc310f0 p\u00e9dagogique, de formation, de perfectionnement, etc.<\/p><p>Au Qu\u00e9bec, les stagiaires qui remplissent certaines conditions sont prot\u00e9g\u00e9s par la Loi visant \u00e0 assurer la protection des stagiaires en milieu de travail.<\/p><p>S\u2019il est une information importante, c\u2019est que le stage en milieu de travail doit \u00eatre r\u00e9mun\u00e9r\u00e9 pour que le stagiaire soit consid\u00e9r\u00e9 comme un travailleur, et par cons\u00e9quent b\u00e9n\u00e9ficier de la protection de la CNESST, notamment en cas d\u2019accident ou de maladie professionnelle advenant durant le stage.<\/p><p>Les stagiaires jouissent aussi d\u2019un certain nombre de droits, comme des absences ou des cong\u00e9s de courte dur\u00e9e pour des \u00e9v\u00e9nements qui peuvent avoir lieu au cours de leur stage. Par cons\u00e9quent, la personne immigrante dont le statut est temporaire doit obtenir un permis de travail pour pouvoir r\u00e9aliser son stage.<\/p><ul><li class=\"p1\">Pour l\u2019\u00e9tudiant qui suit une formation au Qu\u00e9bec assortie d\u2019un stage, l\u2019obtention d\u2019un permis de travail coop est requise.
