Elle prot\u00e8ge naturellement les travailleurs \u00e9trangers temporaires, d\u00e8s lors que ces derniers exercent l\u00e9galement leur travail au Qu\u00e9bec.<\/p><p>De mani\u00e8re g\u00e9n\u00e9rale, la LATMP va venir remplir plusieurs fonctions :<\/p><ul><li>Indemniser rapidement et \u00e9quitablement le travailleur, qu\u2019il s\u2019agisse de frais m\u00e9dicaux ou encore de revenus de remplacement en cas d\u2019incapacit\u00e9 \u00e0 reprendre le travail ;<\/li><li>Permettre la r\u00e9adaptation et faciliter le retour du travailleur en emploi ;<\/li><li>Prot\u00e9ger les travailleuses et des travailleurs contre les repr\u00e9sailles de l\u2019employeur et l\u2019exon\u00e9rer de la preuve d\u2019une faute.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-heading-title elementor-size-default\">La loi visant \u00e0 pr\u00e9venir et \u00e0 combattre le harc\u00e8lement psychologique et la violence \u00e0 caract\u00e8re sexuel en milieu de travail<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1f258a8 elementor-widget elementor-widget-text-editor\" data-id=\"1f258a8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>La Loi visant \u00e0 pr\u00e9venir et \u00e0 combattre le harc\u00e8lement psychologique et la violence \u00e0 caract\u00e8re sexuel en milieu de travail existe en parall\u00e8le du corpus l\u00e9gislatif existant, qu\u2019elle vient essentiellement pr\u00e9ciser et modifier dans le but de mieux prot\u00e9ger les travailleuses et les travailleurs \u00ab dans leur milieu de travail et dans l\u2019exercice de leurs recours \u00bb.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-80ee6c8 elementor-widget elementor-widget-text-editor\" data-id=\"80ee6c8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>La loi d\u00e9finit la notion de violence sexuelle et l\u2019inclut dans l\u2019identification des risques psychosociaux li\u00e9s au travail.<\/p><p>Elle comprend notamment les gestes non d\u00e9sir\u00e9s, \u00e0 connotation sexuelle, les commentaires, les menaces, etc.<\/p><p>La loi a plusieurs objectifs :<\/p><ul><li>Encadrer et prot\u00e9ger la confidentialit\u00e9 des plaintes pour violence sexuelle (introduction de pr\u00e9somptions pour faciliter la reconnaissance de l\u00e9sions, sanctions en cas d\u2019infraction touchant \u00e0 la confidentialit\u00e9, etc.) ;<\/li><li>Modifier le contenu de la Politique de pr\u00e9vention et de prise en charge du harc\u00e8lement, pour tous les employeurs ;<\/li><li>La politique obligatoire de l\u2019employeur doit d\u00e9sormais pr\u00e9voir, en interne, des mesures de formation du personnel, de gestion du processus d\u2019enqu\u00eate, ainsi que des dispositions pour prot\u00e9ger la confidentialit\u00e9 des plaintes et des signalements.<\/li><\/ul><p>Le d\u00e9lai pour porter plainte contre un comportement de violence sexuelle est de deux ans.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2597279 elementor-position-inline-start elementor-mobile-position-inline-start elementor-view-default
