However, specific conditions apply depending on the situation. <\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3bc63ef6 elementor-widget elementor-widget-text-editor\" data-id=\"3bc63ef6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Depending on the case, the worker may be absent from work without pay:<\/p><ul><li><strong>For up to 26 weeks within a 12- month period<\/strong> in cases of illness, accident, domestic or sexual violence, or organ or tissue donation;<\/li><li><strong>For up to 104 weeks<\/strong> if the worker has suffered serious injury as the victim of a criminal act, or was injured during a lawful intervention to prevent a criminal act.<\/li><\/ul><p>In any such case, the Act respecting labour standards (ALS) provides that at least two days per calendar year must be paid.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-59edf7c e-con-full e-flex e-con e-parent\" data-id=\"59edf7c\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-f55d3fc e-con-full e-flex e-con e-child\" data-id=\"f55d3fc\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-a29b6a1 elementor-widget elementor-widget-heading\" data-id=\"a29b6a1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Conditions governing sick leave<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b402bbc elementor-widget elementor-widget-text-editor\" data-id=\"b402bbc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Sick leave and family or parental leave share several common characteristics.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-61f292e elementor-widget elementor-widget-text-editor\" data-id=\"61f292e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li>To be eligible for the two paid days of leave per year, the worker must have completed three months of continuous service.<\/li><li>These days cannot be carried forward to a later year or replaced by financial indemnity.<\/li><li>The business\u2019s collective agreement or internal policy may provide for a greater number of paid leave days than the minimum set out in the Act respecting labour standards (ALS).<\/li><li>If the absence results from an occupational illness or a work-related accident, the worker is covered under the Occupational Health and Safety (OHS) regime administered by the CNESST. Furthermore, certain adjustments may be made to facilitate their return to work. <\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-772ff30 elementor-widget elementor-widget-text-editor\" data-id=\"772ff30\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>In principle, upon returning from leave, the worker has the right to resume their regular position under the same conditions as if they had remained at work. If their position no longer exists at the time of return, they nonetheless retain all associated rights and benefits. <\/p><p>If the absence resulted from a serious physical injury caused by a criminal act, the worker may return to work part-time or intermittently, with the employer\u2019s agreement and for the duration originally allowed for the absence.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-867eec5 elementor-position-inline-start elementor-mobile-position-inline-start elementor-view-default medical<br>certificate?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1d90bb5b elementor-widget elementor-widget-text-editor\" data-id=\"1d90bb5b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">There are two situations in which an employer may request proof of medical absence, such as a doctor\u2019s note:<\/p><ul><li class=\"p2\">From the fourth short-term absence (of three consecutive days or fewer) within a 12- month period;<\/li><li class=\"p2\">As soon as an absence exceeds three consecutive days, even if it is the first absence within those 12 months.<\/li><\/ul><p class=\"p2\">Conversely, for the first three short absences (each lasting up to three consecutive days) in any 12-month period, the employer may not require a medical
