The worker\u2019s legal status determines the possible scenarios available to both the worker and the employer. <\/p><p>There are essentially three possible scenarios when the TFW permit expires:<\/p><ul><li><strong>Scenario 1<\/strong>: The contract ends upon the expiry of the work permit \u2014 either by mutual agreement between the employer and the worker, or because the permit itself is non-renewable.<br><br><\/li><li><strong>Scenario 2<\/strong>: The employer decides to extend\/renew the employment contract, either under the current conditions or under different terms.<br><br><\/li><li><strong>Scenario 3<\/strong>: The worker has begun the process of settling permanently in Quebec.<\/li><\/ul><p>Each scenario offers specific courses of action, both for the employer and for the worker.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-7257d08 e-con-full e-flex e-con e-parent\" data-id=\"7257d08\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-9b2240d e-con-full e-flex e-con e-child\" data-id=\"9b2240d\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-9ba914e elementor-widget elementor-widget-heading\" data-id=\"9ba914e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">End of employment for a TFW<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f145f1e elementor-widget elementor-widget-text-editor\" data-id=\"f145f1e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>A temporary work permit has a defined expiry date, meaning that beyond this date, the worker can no longer legally work in Qu\u00e9bec.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a3fa8e elementor-widget elementor-widget-text-editor\" data-id=\"1a3fa8e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>This date may coincide with the natural end of the employment relationship between the TFW and their employer. However, the termination of employment can occur at any time: the permit\u2019s expiry date does not require the employer to maintain the employment relationship with the TFW until then. <\/p><p>The <strong>early termination of a employment contract with a temporary foreign worker<\/strong>, that is, before the work permit\u2019s expiry, follows the same rules and procedures that apply to all workers. In particular, the provision of notice and payment of any amounts owed. Similarly, when the TFW is the one ending the employment, the notion of a \u201creasonable notice period\u201d applies, though it is less formal.  <\/p><p>A <strong>contract that ends when the worker&rsquo;s work permit expires<\/strong> generally means the TFW&rsquo;s return to their country of origin. When a temporary foreign worker\u2019s work permit expires, and no steps have been taken to maintain their status in the country, they lose their status. Consequently, they may no longer work, but still have 90 days to restore their legal status in Canada. This may be the case, for example, when they wish to secure a new job offer before their work permit expires.<\/p><p style=\"font-weight: 400;\"><span>In such cases, the worker must clearly inform the employer they are leaving. Once this is done, the employer is released from its obligation.  <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-827e3a6 e-flex e-con-boxed e-con e-child\" data-id=\"827e3a6\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4daecd9 elementor-widget elementor-widget-text-editor\" data-id=\"4daecd9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>TFWs who have earned income in Quebec are <strong>subject to income tax<\/strong>, which must be filed by April 30, covering the period from January 1 to December 31 of the previous year. As this process can be completed remotely for TFWs who have returned home, it is recommended to plan ahead before departure, ideally with the help of a certified accountant. several options if they wish to remain in Quebec.<\/p><p class=\"p1\">Firstly, because the permit is employer-specific, t<strong>he worker cannot freely work for another employer<\/strong>. They must find a new employer willing to hire them and undertake the necessary immigration procedures, starting with a Labour Market Impact Assessment (LMIA), in order to obtain a new closed work permit.<\/p><p class=\"p1\">Secondly, <strong>accompanying family members<\/strong> retain their status as long as the principal permit remains valid (spouse&rsquo;s work permit, children&rsquo;s study permit, etc.). If eligible, it is advisable to apply as soon as possible, ideally immediately after job loss. <\/p><p class=\"p1\">Concerning retirement benefits (or disability pensions, for example), bilateral social security agreements may exist between Canada and the TFW&rsquo;s country of origin, allowing them to transfer or combine their pension entitlements earned in Quebec. Indeed, the employer and the temporary foreign worker may also wish to continue or develop their collaboration beyond the initial work permit. <\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a009e52 elementor-widget elementor-widget-text-editor\" data-id=\"a009e52\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>There are two possible scenarios in this case:<\/p><ul><li><strong>In the first case, the worker&rsquo;s status is extended beyond the expiry date of the current work permit.<\/strong> Before the current work permit expires, both parties agree to apply to extend the temporary foreign worker&rsquo;s current status, under the same conditions as the initial hiring (duties, job title, salary, etc.);<\/li><li><strong>The second case is that of the renewal of a valid work permit<\/strong>, either when the parties agree to introduce changes to the position (salary increase, broader responsibilities, new job title, internal promotion, etc.), or when the worker More information on reinstating a status after the initial permit has expired: already holds a valid work permit, whether or not they are still working for another business.<\/li><\/ul><p>In both cases, the procedure is identical, and should be initiated well before the current permit expires. IRCC requires the application to be submitted 30 days in advance. However, certain conditions apply. <\/p><p class=\"p1\">The rule of principle is that a TFW with maintained status, who lives and works in Quebec, loses their status as soon as they leave Canada.
