Several mechanisms are available to them. <\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-51d66f90 elementor-widget elementor-widget-text-editor\" data-id=\"51d66f90\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Once a situation of psychological or sexual harassment in the workplace has been established, the worker can take several actions, depending on the case.<\/p><p>If a worker believes they are being harassed, they may:<\/p><ul><li><strong>Discuss their situation<\/strong> with their employer or union, if possible;<\/li><li><strong>Consult their doctor <\/strong>if they believe their physical or psychological health is in danger;<\/li><li><strong>Report the situation<\/strong> to a <a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/service-clientele\/plaintes-recours\/situations-justifiant-depot-dune-plainte#Danger\" target=\"_blank\" rel=\"noopener\">CNESST inspector<\/a>;<\/li><li><strong><a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/service-clientele\/plaintes-recours\/plaintes-en-normes-travail\/plainte-pour-harcelement-psychologique-sexuel\" target=\"_blank\" rel=\"noopener\">File a complaint<\/a><\/strong> for psychological or sexual harassment in the workplace.<\/li><\/ul><p><strong>The worker has 2 years after the last occurrence of harassment to file a complaint.<\/strong> We also recommend submitting a work accident claim if the harassment has led to a psychological or physical injury certified by a doctor.<\/p><p>Alternatively, and depending on the case, the worker may also consider:<\/p><ul><li><strong><a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/service-clientele\/plaintes-recours\/plaintes-recours-en-sante-securite-travail\/differend-avec-votre-employeur-en-matiere-sante\" target=\"_blank\" rel=\"noopener\">File a workplace dispute complaint<\/a><\/strong> if they believe their work environment endangers their health, safety or physical or psychological integrity. They may also file a complaint if they have been dismissed, suspended or experienced reprisals for having suffered an occupational injury or exercising a right recognized by law. <\/li><li><a href=\"https:\/\/www.cnesst.gouv.qc.ca\/fr\/service-clientele\/plaintes-recours\/plaintes-en-normes-travail\/plainte-pour-pratique-interdite\" target=\"_blank\" rel=\"noopener\"><strong> File a complaint about prohibited practices<\/strong><\/a><\/li><li><strong><a href=\"https:\/\/www.cdpdj.qc.ca\/fr\" target=\"_blank\" rel=\"noopener\">File a complaint with the Commission des droits de la personne et des droits de la jeunesse<\/a><\/strong> if the harassment is related to discrimination under the <em>Charter of Human Rights and Freedoms<\/em>.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-69fe10b elementor-widget elementor-widget-text-editor\" data-id=\"69fe10b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>If an employee witnesses harassment, they must report the situation:<\/p><ul><li>To their employer, the health and safety representative, the health and safety liaison officer, the health and safety committee members,<br>or<\/li><li>a CNESST inspector.<\/li><\/ul><p><strong><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/N-1.1#se:122\" target=\"_blank\" rel=\"noopener\">Section 122 of the Act respecting labour standards<\/a> protects this employee against reprisals.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-6e6bcf7f e-con-full e-flex e-con e-child\" data-id=\"6e6bcf7f\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t<div class=\"elementor-element elementor-element-174c37e3 e-con-full e-flex e-con e-child\" data-id=\"174c37e3\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2eb9edfd elementor-widget elementor-widget-image\" data-id=\"2eb9edfd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img fetchpriority=\"high\" decoding=\"async\" width=\"512\" height=\"512\" src=\"https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir.png\" class=\"attachment-full size-full wp-image-22588\" alt=\"\" srcset=\"https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir.png 512w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-200x200.png 200w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-120x120.png 120w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-24x24.png 24w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-48x48.png 48w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-96x96.png 96w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-150x150.png 150w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-300x300.png 300w, https:\/\/immigrantquebec.com\/fr\/wp-content\/uploads\/2025\/07\/BonASavoir-350x350.png 350w\" sizes=\"(max-width: 512px) 100vw, 512px\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-5a48a285 e-con-full e-flex e-con e-child\" data-id=\"5a48a285\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-3eb81125 elementor-widget elementor-widget-text-editor\" data-id=\"3eb81125\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">To assert their rights, <strong>unionized employees<\/strong> must contact their union directly to file a grievance. The collective agreement generally specifies the procedure to follow. The minimum time limit is always two years, but the collective agreement may provide for a longer period. The union has a duty to represent its members fairly and objectively (Art. 47.2 of the Labour Code).   <\/p><p class=\"p1\"><strong>If the person works for the public service not governed by a collective agreement<\/strong>, including members and managers of a public body, they may file a recourse with the Public Service Commission:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div
