Inscrite au budget f\u00e9d\u00e9ral 2022, elle entend emp\u00eacher une grande partie des investissements \u00e9trangers dans le secteur de la propri\u00e9t\u00e9 r\u00e9sidentielle au Canada, d\u00e8s le 1er janvier 2023 et pour une p\u00e9riode de deux ans.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>Par d\u00e9faut, la loi s\u2019applique \u00e0 toutes les personnes qui ne sont ni citoyennes canadiennes ni r\u00e9sidentes permanentes. En cela, elle soul\u00e8ve certains questionnements parmi les personnes dont le statut est temporaire.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>Qu\u2019en est-il, alors\u2009? Quels types de biens sont concern\u00e9s par la mesure\u2009? Les travailleurs temporaires et \u00e9tudiants \u00e9trangers, pourront-ils acqu\u00e9rir un bien immobilier avant 2025\u2009?<\/span><\/p>\n<h2><span>Comprendre la volont\u00e9 du l\u00e9gislateur<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span>Sur son site, le Parti lib\u00e9ral, actuellement au pouvoir au Canada, <\/span><span><a href=\"https:\/\/liberal.ca\/fr\/logement\/interdire-les-achats-immobiliers-aux-etrangers\/\" target=\"_blank\" rel=\"noopener\">l\u2019annonce sans d\u00e9tour<\/a><\/span><span> : \u00ab\u2009Nous interdirons temporairement l\u2019achat de propri\u00e9t\u00e9s par des \u00e9trangers sur le march\u00e9 r\u00e9sidentiel canadien afin de veiller \u00e0 ce que les Canadiens aient un plus large acc\u00e8s \u00e0 l\u2019achat de propri\u00e9t\u00e9s.\u2009\u00bb<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>Sortie de pand\u00e9mie, inflation et explosion des taux d\u2019int\u00e9r\u00eat, p\u00e9nurie de logements et taux d\u2019occupation records dans de nombreuses provinces sont autant de facteurs exceptionnels qui permettent d\u2019expliquer la mesure. Mais l\u2019objectif est bien avant tout de prot\u00e9ger les Canadiens de la sp\u00e9culation immobili\u00e8re qui s\u00e9vit un peu partout au pays, non de priver les gens de faire valoir leur droit \u00e0 la propri\u00e9t\u00e9.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>C\u2019est la raison pour laquelle des exceptions sont pr\u00e9vues \u00e0 la r\u00e8gle de principe.<\/span><\/p>\n<h2><span>Les propri\u00e9t\u00e9s concern\u00e9es par la mesure<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span>Pour commencer, seuls certains biens sont vis\u00e9s. Il s\u2019agit de la plupart des immeubles r\u00e9sidentiels : copropri\u00e9t\u00e9s, maisons individuelles, maisons jumel\u00e9es et b\u00e2timents de trois logements maximum (duplex, triplex).<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>La d\u00e9finition et le sort des terrains vacants zon\u00e9s \u00e0 des fins r\u00e9sidentielles (ou mixte) et des propri\u00e9t\u00e9s r\u00e9cr\u00e9atives seront d\u00e9termin\u00e9s dans le r\u00e8glement d\u2019application de la loi, qui n\u2019a pas encore \u00e9t\u00e9 publi\u00e9 \u00e0 l\u2019heure o\u00f9 nous publions ce texte.<\/span><\/p>\n<h2><span>Des exceptions qui touchent aux personnes<\/span><\/h2>\n<p style=\"font-weight: 400;\"><span>Ensuite, d\u2019autres exceptions sont attendues, qui tiennent cette fois au statut des personnes. En premi\u00e8re lecture, la loi semble exclure les personnes immigrantes dont le statut est temporaire (\u00e0 l\u2019exception des conjoints et \u00e9poux d\u2019un citoyen ou d\u2019un r\u00e9sident permanent canadien co-acheteur). Or, il semble entendu que les \u00e9tudiants \u00e9trangers, les travailleurs \u00e9trangers temporaires, les personnes r\u00e9fugi\u00e9es, et peut-\u00eatre certaines personnes de corps diplomatiques seront bel et bien \u00e9pargn\u00e9s.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span>\u00c0 nouveau, les crit\u00e8res exacts d\u2019exemption seront pr\u00e9cis\u00e9s par le r\u00e8glement d\u2019application d\u2019une loi dont l\u2019objectif principal demeure, rappelons-le, de prot\u00e9ger l\u2019acc\u00e8s au logement des r\u00e9sidents du Canada.<\/span><\/p>\n<p
