Voici quelques conseils pour mieux n\u00e9gocier votre contrat de travail et faire valoir les droits qu\u2019elle vous donne.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Prenez votre temps !<\/strong><\/h3>\n<p style=\"text-align: justify;\">S\u2019il est vrai qu\u2019un contrat de travail peut \u00eatre conclu oralement, en cas de m\u00e9sentente, il est toujours mieux d\u2019\u00eatre en mesure de prouver les conditions que vous avez n\u00e9goci\u00e9es avec votre employeur. Pour cela, tout document \u00e9crit est suffisant, que ce soit par exemple une lettre d\u2019embauche ou un courriel confirmant une entente. Id\u00e9alement, votre employeur vous fera signer un contrat, vous permettant d\u2019\u00eatre bien au fait de vos droits et obligations.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Gagnez du temps !<\/strong><\/h3>\n<p style=\"text-align: justify;\">Au Qu\u00e9bec, dans la plupart des cas, apr\u00e8s quarante heures travaill\u00e9es, l\u2019employeur doit verser une r\u00e9mun\u00e9ration major\u00e9e de 50%, pour chaque heure suppl\u00e9mentaire.<\/p>\n<p style=\"text-align: justify;\">Mais attention, la loi est mal faite. Si vous ne pouvez d\u00e9terminer votre taux horaire, vous ne pourrez exiger d\u2019\u00eatre pay\u00e9 pour le temps suppl\u00e9mentaire travaill\u00e9, tant que votre salaire reste au-dessus du salaire minimum. Or, en r\u00e9mun\u00e9rant les heures suppl\u00e9mentaires tel que pr\u00e9vu par la loi, une semaine de 60 heures au salaire minimum de 9,90 $ \u00e9quivaut \u00e0 un revenu annuel d\u2019environ 36 000 $.<\/p>\n<p style=\"text-align: justify;\">Si vous croyez que vos comp\u00e9tences devraient vous donner un salaire \u00e9quivalant \u00e0 deux ou trois fois le salaire minimum, il vaut mieux vous assurer que vous obtiendrez un salaire qui tiendra compte de vos comp\u00e9tences et des heures que vous aurez \u00e0 travailler.<\/p>\n<p style=\"text-align: justify;\">Il est donc tr\u00e8s important pour vous de pouvoir d\u00e9terminer votre taux horaire. La solution la plus simple consiste \u00e0 convenir d\u2019un taux avec votre employeur ainsi que du nombre d\u2019heures que vous aurez \u00e0 travailler. Vous pourrez \u00e9galement conclure une entente, comme par exemple \u00e9changer les heures suppl\u00e9mentaires travaill\u00e9es contre des journ\u00e9es de cong\u00e9, en tenant compte des majorations pr\u00e9vues par la loi. \u00c0 vous de n\u00e9gocier avec votre employeur !<\/p>\n<h3 style=\"text-align: justify;\"><strong>Offrez-vous du bon temps !<\/strong><\/h3>\n<p style=\"text-align: justify;\">Les cong\u00e9s sont un \u00e9l\u00e9ment indispensable de tout contrat de travail. Au Qu\u00e9bec, des vacances annuelles de quatre semaines ne sont pas rares. Prendre des vacances \u00e0 la p\u00e9riode de votre choix, les fractionner, prendre des cong\u00e9s sans solde\u2026 Autant de droits que vous pouvez n\u00e9gocier avant de signer votre contrat de travail.<\/p>\n<p style=\"text-align: justify;\">Avec l\u2019accord de votre employeur, vous pouvez par exemple prendre vos cong\u00e9s annuels par anticipation. Vous pourriez donc profiter de vacances d\u00e8s la premi\u00e8re ann\u00e9e de votre embauche. Savez-vous qu\u2019en plus des deux semaines de cong\u00e9s annuels pay\u00e9s, vous avez le droit, \u00e0 partir de la deuxi\u00e8me ann\u00e9e, de demander une semaine de cong\u00e9 non r\u00e9mun\u00e9r\u00e9 par ann\u00e9e ? Peu importe le type de vacances que vous avez l\u2019intention de prendre, tentez de les n\u00e9gocier \u00e0 l\u2019avance afin de vous assurer que vos dates conviennent \u00e0 votre employeur. Planifiez \u00e0 l\u2019avance, prenez toutes les pr\u00e9cautions n\u00e9cessaires et, votre famille et vous b\u00e9n\u00e9ficierez d\u2019une meilleure qualit\u00e9 de vie.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Pas de temps \u00e0 perdre !<\/strong><\/h3>\n<p style=\"text-align: justify;\">La Commission des normes du travail veille \u00e0 l\u2019application de la loi pour les travailleurs non syndiqu\u00e9s, mais les d\u00e9lais sont souvent serr\u00e9s. Ceux-ci varient de 45 jours \u00e0 un an.
